Please read these Terms and Conditions carefully before making a booking with Paynes of Rathmichael. By submitting a booking request or paying a deposit, you confirm that you have read, understood, and agree to be bound by these terms on behalf of yourself and all passengers in your group.
These Terms and Conditions govern all bookings for coach hire and tours provided by Stephen Payne, trading as Paynes of Rathmichael, Rathmichael, County Dublin, Ireland (hereinafter referred to as "Paynes", "we", "us", or "the Operator"). Stephen Payne is a sole trader and a certified Irish National Driver Guide (Fáilte Ireland).
All enquiries and bookings are made directly with the Operator. Paynes does not use third-party booking agents for domestic bookings.
2.1 Enquiry: Submitting a form on our website, sending an email, or making a telephone call constitutes an enquiry only — not a confirmed booking.
2.2 Quotation: Following your enquiry, we will provide a written quotation by email. The quotation will specify the route, date(s), vehicle, passenger capacity, and total price. Prices quoted are inclusive of driver, fuel, tolls, and all applicable taxes unless otherwise stated. Prices exclude passenger insurance, ferry crossings, third-party entrance fees, accommodation, and meals unless specifically included in writing.
2.3 Confirmation: A booking is only confirmed when:
Paynes reserves the right to decline any booking request at its sole discretion.
3.1 Deposit: A non-refundable deposit of 25% of the total booking value is required to confirm your booking. The deposit amount will be specified in your quotation.
3.2 Balance: The remaining balance is due no later than 28 calendar days before the date of travel. For bookings made within 28 days of travel, the full amount is due immediately upon confirmation.
3.3 Payment Methods: Accepted payment methods will be confirmed by the Operator in the quotation. We typically accept bank transfer (EFT) and cash. Credit/debit card payments may be available — please enquire.
3.4 Late Payment: If the balance is not received by the due date, Paynes reserves the right to treat the booking as cancelled and apply the cancellation charges set out in Section 5.
4.1 All prices are quoted and payable in Euro (€) unless otherwise agreed in writing.
4.2 Prices are based on the specific route, date, vehicle type, and passenger numbers confirmed at the time of quotation. Any material change to these details may result in a revised quotation.
4.3 Paynes reserves the right to apply a fuel or ferry surcharge where significant cost increases occur after booking confirmation and before the date of travel, provided written notice is given to the customer at least 21 days before departure.
All cancellation requests must be made in writing to Paynesofrathmichael@gmail.com. Cancellation charges are applied based on the number of days' notice given before the confirmed date of travel:

The deposit is non-refundable in all circumstances. Cancellation charges are calculated on the total booking value including the deposit.
We strongly recommend that all passengers take out appropriate travel insurance that covers cancellation for any reason, including illness or injury.
6.1 In the unlikely event that Paynes must cancel a confirmed booking for reasons within its control, we will offer the customer a full refund of all monies paid, or an alternative date/vehicle if available. We will not be liable for any additional costs incurred by the customer (e.g. accommodation, flights, onward travel) beyond the refund of the hire fee itself.
6.2 Paynes reserves the right to substitute a vehicle of equal or greater specification if the originally booked vehicle becomes unavailable due to mechanical failure or other unforeseen circumstances. This will not constitute a cancellation.
6.3 Paynes reserves the right to make minor amendments to tour itineraries where circumstances require (e.g. road closures, attraction closures, weather). We will always endeavour to provide an equivalent alternative.
Paynes shall not be liable for any failure to perform, or delay in performance of, any obligation under these Terms caused by events beyond our reasonable control, including but not limited to:
In force majeure circumstances, Paynes will endeavour to provide a suitable alternative or reschedule travel. Where this is not possible, Paynes may offer a credit note or partial refund at its discretion. Paynes shall not be obliged to issue a full refund in genuine force majeure events.
8.1 The driver/operator has the right to refuse entry to, or to remove from, the vehicle any passenger whose behaviour is deemed to be abusive, threatening, intoxicated, or likely to endanger other passengers, the driver, or third parties. No refund will be issued in such circumstances.
8.2 Passengers are expected to comply with all reasonable instructions from the driver. This includes seat belt usage (mandatory under Road Traffic legislation in Ireland).
8.3 The consumption of alcohol on board is not permitted unless expressly agreed in writing by Paynes prior to the journey.
8.4 Smoking (including e-cigarettes and vaping) is strictly prohibited on all Paynes vehicles at all times.
8.5 Passengers causing damage to the vehicle — whether by accident or misconduct — will be held financially responsible for the cost of repair or replacement. This includes but is not limited to upholstery, fittings, windows, toilets, and entertainment systems.
9.1 Passengers are responsible for their own luggage and personal belongings at all times. Paynes accepts no liability for loss of, damage to, or theft of any personal property carried on board or in the luggage hold.
9.2 Passengers are advised not to leave valuables unattended in the vehicle. The vehicle may not always be lockable during stops.
9.3 Luggage should be of a reasonable quantity and size given the coach capacity booked. The driver may refuse to carry excessive or hazardous items.
10.1 Paynes of Rathmichael carries valid public liability insurance and passenger liability insurance as required under Irish Road Traffic legislation. Stephen Payne holds a valid Road Passenger Transport Operator licence.
10.2 To the maximum extent permitted by Irish law, Paynes shall not be liable for:
10.3 Nothing in these Terms limits Paynes' liability for death or personal injury caused by the Operator's proven negligence, or for any other liability that cannot be excluded under Irish law.
11.1 Tour itineraries as described on our website are intended as a guide only. Exact timings, routes, and visit durations may vary depending on road conditions, traffic, passenger requirements, and third-party operating hours.
11.2 Entrance fees to attractions, heritage sites, and optional excursions are not included in the tour price unless explicitly stated in the written quotation. Paynes cannot guarantee the availability or opening status of any third-party attraction.
11.3 Accommodation and meals are not included in tour prices unless explicitly stated in the written quotation.
11.4 Multi-day overnight tours that include both transport and accommodation as a combined package may be subject to the Package Travel and Linked Travel Arrangements Regulations 2019 (S.I. No. 80 of 2019), which implement EU Directive 2015/2302 in Ireland. Where applicable, Paynes will provide all required pre-contractual information in writing before booking is confirmed.
All departure and arrival times provided are estimates only. Journey times may be affected by traffic, road conditions, weather, ferry schedules, and unforeseen events. Paynes shall not be liable for any costs or losses arising from late arrival at a destination.
If you have a complaint regarding your experience with Paynes, please raise it with Stephen Payne at the earliest opportunity during the trip. If the matter is not resolved to your satisfaction, you may submit a formal written complaint to Paynesofrathmichael@gmail.com within 28 days of the date of travel. We will acknowledge receipt within 5 business days and aim to resolve the matter within 28 days.
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Ireland. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the Irish courts.
If any provision of these Terms is found to be unlawful, invalid, or unenforceable under Irish law, that provision shall be deemed severed from these Terms. The remaining provisions shall continue in full force and effect.
These Terms and Conditions, together with the written quotation issued by Paynes for your specific booking, constitute the entire agreement between the parties and supersede any prior oral or written representations made in the course of enquiry.
